¿Qué es Infraestructura Hotelera y Turística?

Este subsector incluye la construcción y operación de hoteles, así como agencias para promover el turismo y la venta de servicios turísticos y de recreación.  El sector de infraestructura hotelera y turística es esencial para el país, pues Colombia es considerado un destino único gracias a su megadiversidad, variedad de climas, riqueza cultural, la calidez de su gente y sus atractivos turísticos, esto permite a los visitantes extranjeros vivir experiencias inigualables en todas las regiones del país. Entre las alternativas de inversión extranjera que tiene actualmente el país están:

Ecoturismo: esta actividad permite invertir en la infraestructura hotelera en zonas rurales, que aprovechen la biodiversidad de la naturaleza en Colombia.

Glamping: Es posible invertir en las experiencias de acampar al aire libre sin dejar de lado la comodidad y las condiciones propias de un alojamiento tradicional en un hotel.

Eco Luxury: Contempla la oportunidad de construir hoteles tipo ecolodges.

Hoteles urbanos: Este tipo de inversiones brindan oportunidades de realizar actividades desde la categoría económica hasta la de lujo, también se pueden enfocar los servicios al mercado joven, corporativo, vacacional o adultos mayores (senior living). 

Entretenimiento: Es la oportunidad para realizar actividades de construcción de parques temáticos, centros de espectáculos y eventos.

Sol y playa: Esta alternativa contempla el desarrollo de resorts tipo all inclusive y hoteles de lujo.
Infraestructura turística: Comprende las oportunidades en la construcción de muelles turísticos; bases náuticas y marinas; infraestructura para avistamiento de aves entre otros.

¿Por qué invertir en Infraestructura Hotelera y Turística?

Las políticas de gobierno han establecido nuevas leyes de crecimiento económico, donde se ofrece un Impuesto de Renta preferencial para hoteles, parques temáticos, agroturismo ecoturismo y muelles nuevos, convirtiéndose en una gran ventaja para la inversión extranjera de acuerdo con lo siguiente: 

En municipios de menos de 200 mil habitantes la tarifa de renta será de 9 % por 20 años y este incentivo estará vigente hasta 2029. Por otro lado, para las ciudades de más de 200 mil habitantes este incentivo de tarifa de 9 % aplicará por 10 años y estará vigente hasta 2023.

Otro factor diferenciador del país es que cuenta con 13 aeropuertos internacionales y está ubicado a menos de 6 horas de las principales ciudades del continente americano, beneficiando así la inversión de capital extranjero con altas tasas de retorno de la inversión.

1 - Apply for an Environmental License

The Environmental License refers to the authorization for the execution of a project, work, or activity that could cause serious damage to renewable natural resources or the environment, or generate changes to the landscape.

What do I need to apply for an environmental license?

  1. You must submit the single environmental license form.

  2. Have the supporting plans for the Environmental Impact Study.

  3. Know the estimated investment and operating costs of the project.

  4. Submit the duly granted “Power of Attorney” when acting through a representative.

  5. Submit proof of payment for the environmental license evaluation service.

  6. Have the Certificate of Existence and Legal Representation.

  7. Process and submit the Certificate from the Ministry of the Interior on the presence or absence of ethnic communities and the existence of collective territories in the project area.

  8. If ethnic communities exist, you must carry out the “prior consultation” process, which gives ethnic communities access and participation in learning about projects or works to be carried out in their territories, provided that they are likely to affect them directly.

  9. You must submit a copy of the filing of the document required by the ICANH (Colombian Institute of Anthropology and History) to verify that there are no archaeological remains in the project area.

  10. Complete the form approved by the competent environmental authority as appropriate (ANLA, Regional CAR, or Ministry of the Environment).

What steps should be taken to apply for an Environmental License?

  1. Request the NDA (Environmental Diagnosis Need) form.

  2. Submit the DAA (Environmental Diagnosis of Alternatives) to evaluate and compare the different alternatives under which it is possible to develop the project, work, or activity.

  3. Attend the meeting with the competent environmental authority to present the results of the preliminary verification of documentation.

  4. Notify the respective authority of the start of the Environmental License Application process.

  5. Receive a technical visit from the responsible entity (ANLA, CAR, Minambiente) if required.

  6. Notify the administrative act that defines the alternative for the development of the project.

  7. Request the settlement of the cost for the evaluation of the environmental license.

  8. Make the payment for the evaluation of the environmental license.

What is the cost of this procedure?

It depends on the fees charged by the environmental agency (in accordance with Article 96 of Law 633 of 2000). The fees are set by means of resolutions.

"In the case of caps, according to Article 96 of Law 633 of 2000, it was determined that fees may not exceed the following caps:

  1. Those with a value of two thousand one hundred and fifteen (2,115) current minimum monthly wages will have a maximum fee of zero point six percent (0.6%).

  2. Those with a value greater than two thousand one hundred and fifteen (2,115) current monthly minimum wages and less than eight thousand four hundred and fifty-eight (8,458) current monthly minimum wages will have a maximum rate of zero point five percent (0.5%).

  3. Those with a value greater than eight thousand four hundred fifty-eight (8,458) current monthly minimum wages will have a maximum rate of zero point four percent (0.4%).

For example:

Project value = COP$18 billion.

Environmental impact study equals 10% of the project value = COP$1.8 billion.

Maximum cost of the assessment = COP$6,535,041.

2 - Apply for a Building Permit

In the event of executing a construction project, whether it be new construction, expansion, remodeling, modification, adaptation, reconstruction, demolition, or structural reinforcement, prior permission must be obtained from the urban planning authority or a similar authority in each municipality.

What do I need to apply for a building permit?

  1. You need a copy of the certificate of ownership and transfer dated no more than 30 days prior to issuance.

  2. You need a copy of the identity document of the person or legal representative.

  3. A copy of the property tax payment for the last year.

  4. You need to have a list of the addresses of the properties or buildings adjacent to the project.

  5. You need a copy of the architectural project labeled and signed by a licensed architect (the labeling refers to basic project information such as):

    • Project: Type of work to be built.

    • Contents: Names and details of the plans for each floor to be built.

    • Owners: Names of the people for whom the construction will be carried out.

    • Address: Place or site where the construction will take place.

    • Scale and date: The scale used in each plan and the date of completion of the plans.

    • Number of floors.

    • Name of the project draughtsman.

    • Design is the name of the architect who designed the project to be built.

    • Calculation is the name of the engineer who supported the preparation of the plans.

  6. The architectural project must contain at least the following information:

    • Location.

    • Floor plans.

    • Elevations or sections of the building related to public or private roads on a formal scale. When the project is located on sloping ground, the sections must indicate the actual slope of the terrain.

    • Facades.

    • Roof plan: that is, the plan showing the shape of the upper part of the buildings, i.e., the shape of the roof.

    • Area table: refers to information on the total square meters of a built area and the division of these into the different zones that comprise it.

  7. You must submit the Single National Form for project review and information to the Urban Curator or responsible entity.

  8. If you are acting through a representative, you must submit the special power of attorney, duly granted before a notary or judge of the republic.
